The following terms and conditions govern the use of PEAKASSET's website/s ("peakasset.ph") and/or PEAKASSET's mobile application/s ("PEAKASSET Mobile App"). The PEAKASSET Website and PEAKASSET Mobile App shall collectively be referred to as the "PEAKASSET Media."

1. GENERAL. By using the PEAKASSET Media, you (the "User") agree to be bind by these terms and conditions and voluntarily invested to PEAKASSET. If the User does not agree to any of the terms and conditions, access to the PEAKASSET Media is disallowed.

2. INTELLECTUAL PROPERTY RIGHTS. Everything in the PEAKASSET Media, including all real time or other information and content as well as any software programs available on or through the PEAKASSET Media ("Content"), are protected by intellectual property rights laws. With the exception of information obtained from PEAKASSET's third party providers, all right, title and interest in and to the PEAKASSET Media and its Content are owned, licensed or controlled by PEAKASSET. PEAKASSET reserves the right to amend or withdraw any of the PEAKASSET Media.

3. OWNERSHIP AND USE OF PEAKASSET MEDIA. PEAKASSET grants access to the PEAKASSET Media to the User exclusively for his personal, non-commercial, and lawful use. User agrees not to transmit, transfer, perform, broadcast, publish, reproduce, create a derivative work from, distribute, sell, license, rent, lease or otherwise transfer any Content to any third person (including, without limitation, others in User's company or organization) whether for direct commercial or monetary gain or otherwise without the prior written permission of PEAKASSET. Requests for such permission must be in formal letter and should be sent to: 3rd & 4th Flr. Blesscent Marketing Milan Prestige Building Brgy. Halang, Calamba City, Laguna, Philippines.

4. LIMITATION OF LIABILITY. While the Content has been obtained from sources believed to be reliable, they are provided on an "AS IS" and "AS AVAILABLE" basis. PEAKASSET, its affiliates, officers, directors, employees, and agents do not make any representations and disclaim all express, implied and statutory warranties of any kind, including, but not limited to, those regarding accuracy, timeliness, completeness, correctness, timeliness, non-infringement, merchantability, or fitness for any particular purpose, or any representations or warranties arising from usage or custom or trade or by operation of law. Further, User acknowledges that due to the number of sources from where the Contents are obtained from, and the inherent hazards of electronic distribution, there may be omissions or inaccuracies in the Content. Lastly, User agrees not to hold PEAKASSET liable for any damages, including without limitation direct or indirect, special, incidental, or consequential damages, losses or expenses arising in connection with the PEAKASSET Media or Third Party Media (as hereinafter defined) or use thereof or inability to use by any party, or in connection with any failure of performance, error, omission, interruption, defect, delay in operation or transmission, computer virus or line or system failure, even if PEAKASSET, or representatives thereof, are advised of the possibility of such damages, losses or expenses. Any claims arising in connection with the use of PEAKASSET Media must be brought within one (1) year from the date the event giving rise to such action occurred, exclusively with the appropriate courts of Calamba City, Laguna, Philippines.

5. LINKS. The PEAKASSET Media may contain links to other websites or applications controlled or offered by third party providers ("Third Party Media"). PEAKASSET disclaims liability for any information, material, product, or service posted or offered at said Third Party Media. The link to said Third Party Media does not mean an endorsement or recommendation from PEAKASSET for any products or services offered or information contained in said Third Party Media. Neither shall PEAKASSET be liable for any failure of the products or services offered or advertised at the Third Party Media. User is aware that the use of Third Party Media may be governed by differed terms and conditions and that said Third Party Media may provide less security than the PEAKASSET Media.

6. CHANGES TO TERMS AND CONDITIONS.. PEAKASSET may modify these terms and conditions at any time without prior notice. The continued use of the PEAKASSET Media following publication of the amended terms and conditions will constitute User's acceptance of the amendment.

7. PAYMENTS AND WITHDRAWALS.

   7.1 All payments shall be made by cash, checks, or online bank transfers, which shall either be delivered to PEAKASSET’s office or deposited and credited to a designated bank account of PEAKASSET. Client shall not be credited with any deposited funds until PEAKASSET receives cleared funds in the amount stated in the deposit form, less bank charges, if any.

   7.2 Any request for cash or withdrawals from Client shall be fill out the withdrawal option. The request is subject to PEAKASSET’s approval within three working days, provided, that the Client shall assume all the risk or loss that may result thereto.

   7.3 In case the account owner uses other bank details it will forward an authorization letter to PEAKASSET admin and it is subject to PEAKASSET’s approval.

8. TRADING FEES. In consideration of the foregoing, the Client hereby agrees to pay PEAKASSET Transfer / settlement fees, and transaction fees at 1.5% per executed order. The Client agrees that PEAKASSET may change the transaction rate at any time upon reasonable notice.

9. VIOLATION OF TERMS AND CONDITIONS OF USE. PEAKASSET reserves the right to seek all remedies available at law and equity for violations of these terms and conditions, including the right to block access from a particular Internet address to the PEAKASSET Media.
